1. Who we are
The Website is operated by Kuentoo B.V. ("Kuentoo", "we", "us", "our"), a company established in Kralendijk, Bonaire, Caribbean Netherlands. Kuentoo provides payment infrastructure and merchant acquiring services for the Dutch Caribbean.
2. About Kuentoo services
The Website describes Kuentoo's products and services, including in-store and online card acceptance, payment terminals, SoftPOS, payment links and local settlement. The Website itself is informational. The actual payment and acquiring services are provided only to businesses that have completed onboarding and entered into a separate written agreement with Kuentoo (the "Merchant Agreement"). Nothing on the Website is a binding offer to provide payment services, and pricing shown on the Website is indicative unless confirmed in a signed quote or Merchant Agreement.
3. Use of the Website
You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to:
- use the Website in any way that breaches applicable laws or regulations;
- attempt to gain unauthorised access to the Website, its servers, or any connected system or network;
- introduce malware, or otherwise interfere with the proper working of the Website;
- scrape, copy, or harvest content or data from the Website except as permitted by these Terms or applicable law;
- use the Website to transmit unsolicited communications or impersonate Kuentoo or any other person.
4. Accounts and merchant services
Some parts of the Website, such as the merchant portal and payment pages, require an account or are accessed through a secure link. You are responsible for keeping your login credentials and two-factor authentication device confidential, and for all activity under your account. Access to and use of merchant services is governed by the Merchant Agreement and the applicable merchant terms provided to you during onboarding, which prevail over these Terms in the event of a conflict for those services.
5. Intellectual property
The Website and its content — including text, graphics, logos, the Kuentoo name and brand, layout and software — are owned by or licensed to Kuentoo and are protected by intellectual property laws. You may view and print pages for your own reference. You may not otherwise copy, reproduce, republish, or exploit any part of the Website without our prior written permission.
6. Third-party links and content
The Website may contain links to third-party websites and reference third-party payment methods, networks, and service providers. We provide these for convenience only. We do not control and are not responsible for the content, products, or practices of any third party.
7. Availability and no warranty
We aim to keep the Website available and its content accurate, but we provide the Website "as is" and "as available". We do not warrant that the Website will be uninterrupted, error-free, or free of harmful components, or that the information on it is complete or up to date. We may change, suspend, or withdraw all or part of the Website at any time.
8. Limitation of liability
To the fullest extent permitted by law, Kuentoo is not liable for any indirect or consequential loss, or for any loss of profit, revenue, data, or goodwill, arising out of or in connection with your use of the Website. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This section concerns use of the Website only; liability relating to payment services is governed by the Merchant Agreement.

Our Privacy Policy explains how we collect and process personal data in connection with the Website and our services. By using the Website you acknowledge that processing.
10. Changes to these Terms
We may update these Terms from time to time. The version published on this page, with the "Last updated" date above, is the version that applies. Your continued use of the Website after a change means you accept the updated Terms.
11. Governing law and jurisdiction
These Terms are governed by the laws applicable in Bonaire, Caribbean Netherlands (the BES islands). Any dispute relating to the Website or these Terms will be submitted to the competent court of that jurisdiction, unless mandatory law provides otherwise.
